Agreement to Terms

These Terms of Service ("Terms") govern your use of Mwalimu Digital ("Service"), operated by Mwalimu Digital ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our Service.

Description of Service

Mwalimu Digital is an educational technology platform that provides:

• AI-powered generation of CBC-compliant schemes of work
• Educational content and curriculum resources
• Document generation and export services
• Digital wallet and payment processing
• Cloud storage for educational materials

Our Service is designed for educators in Kenya and is aligned with the Competency-Based Curriculum (CBC) framework.

User Accounts

Account Creation

To use our Service, you must:

• Be at least 18 years old
• Be a qualified educator or work in an educational institution
• Provide accurate and complete information
• Maintain the security of your account credentials

Account Responsibilities

You are responsible for:

• All activities that occur under your account
• Maintaining accurate account information
• Protecting your password and account security
• Notifying us immediately of unauthorized use

Payment Terms

Pricing and Payments

• Scheme generation requires payment as displayed on our platform
• Payments are processed through secure third-party providers (M-Pesa, banks)
• All prices are in Kenyan Shillings (KES) unless otherwise stated
• Prices may change with 30 days' notice

Digital Wallet

• Top up your wallet using M-Pesa or bank transfer
• Wallet funds do not expire but are non-refundable
• Minimum top-up amounts may apply

Refunds

Refunds are available only in cases of:

• Technical failure preventing scheme generation
• Duplicate charges due to system error
• Service unavailability for extended periods

Refund requests must be made within 7 days of the transaction.

Acceptable Use Policy

Permitted Uses

You may use our Service for:

• Creating schemes of work for educational purposes
• Personal educational planning and preparation
• Legitimate teaching and learning activities

Prohibited Activities

You may not:

• Resell, redistribute, or commercialize generated content
• Attempt to reverse engineer or copy our technology
• Use automated tools to access our Service
• Violate any applicable laws or regulations
• Impersonate others or provide false information
• Interfere with or disrupt our Service
• Upload harmful or malicious content

Intellectual Property Rights

Our Content

All content, features, and functionality of our Service, including but not limited to:

• Software, algorithms, and source code
• CBC curriculum data and educational content
• Design, graphics, and user interface
• Trademarks, logos, and branding

are owned by us and protected by intellectual property laws.

Generated Content

You retain ownership of schemes of work generated using our Service for your personal educational use. However:

• CBC curriculum content remains the property of the Ministry of Education
• Generated content is for personal/institutional use only
• Commercial redistribution requires separate licensing

User Feedback

Any feedback, suggestions, or ideas you provide become our property and may be used to improve our Service without compensation.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using our Service, you consent to the collection and use of information as described in our Privacy Policy.

Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. Our Service may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Technical issues or system failures
• Third-party service interruptions
• Force majeure events

We will make reasonable efforts to notify users of planned maintenance.

Educational Content

While we strive for accuracy, generated schemes should be reviewed by qualified educators before use. We do not guarantee:

• Complete accuracy of all generated content
• Suitability for all teaching contexts
• Compliance with specific institutional requirements

Service Warranty

Our Service is provided "as is" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages arising from use of generated content
• Third-party actions or service interruptions

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our Service, violation of these Terms, or infringement of any rights of third parties.

Account Termination

Termination by You

You may terminate your account at any time through your account settings or by contacting us.

Termination by Us

We may terminate your account for:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• Non-payment of fees

Effect of Termination

Upon termination, your access to the Service will cease, and your data may be deleted after a reasonable notice period.

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Kenya.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
